Terms of Service

1. Acceptance of Terms

By accessing medhha.com or engaging Med Inc for home health services, you agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Services Offered

Med Inc is a Florida home health agency providing certified Home Health Aide (HHA) services in Collier County and surrounding areas. Skilled nursing and therapy services are planned for future release.

3. Eligibility

Care services are available to individuals residing in our service area who require non-medical home support. Acceptance of any patient is at Med Inc's sole discretion based on assessed needs, payer source, geographic location, and caregiver availability.

4. Payment & Billing

• Services are billed at rates agreed upon at intake and documented in your service agreement.
• We accept Medicaid (when authorized), private insurance, long-term care insurance, and private pay.
• Private pay invoices are due within 15 days of receipt. Past-due balances may incur a 1.5% monthly service charge.
• You are responsible for any amounts your insurer denies or does not cover.

5. Cancellation Policy

Visits cancelled with less than 24 hours notice may be billed at 50% of the scheduled rate. We reserve the right to terminate services with 14 days written notice for non-payment, safety concerns, or changes in care needs beyond our scope.

6. Caregiver Conduct & Limitations

Med Inc caregivers do not:

• Administer medications by injection or IV (HHAs may only assist with self-administration of oral medications).
• Perform skilled nursing tasks (wound care, catheter care, tube feedings).
• Provide transportation in their personal vehicles unless explicitly authorized.
• Accept gifts, gratuities, loans, or financial favors from patients or families.
• Witness wills, powers of attorney, or other legal documents.

7. Patient Responsibilities

• Provide a safe working environment free of weapons, illegal drugs, and aggressive animals.
• Notify Med Inc of changes in health condition, medications, or living situation.
• Treat caregivers with respect; harassment of any kind is grounds for immediate termination.
• Allow caregivers to follow standard infection-control practices.

8. Limitation of Liability

Med Inc carries professional liability and workers' compensation insurance as required by Florida law. Our total liability for any claim arising from services shall not exceed the total amount paid for services in the 12 months preceding the incident. We are not liable for indirect, consequential, or punitive damages.

9. Use of the Website

You agree not to:

• Submit false information through our forms.
• Attempt to access non-public areas of our systems.
• Upload malicious code or attempt to disrupt service.
• Scrape or republish content without permission.

10. Electronic Signatures & Communications

You consent to the use of electronic signatures and electronic delivery of notices, including service agreements, W-9 forms, and policy updates, under the U.S. E-SIGN Act (15 U.S.C. § 7001).

11. Dispute Resolution

We encourage you to contact us first to resolve any concern. Disputes that cannot be resolved informally will be settled by binding arbitration in Collier County, Florida, under the rules of the American Arbitration Association.

12. Governing Law

These Terms are governed by the laws of the State of Florida. Any legal action must be filed in the state or federal courts located in Collier County, Florida.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after the change constitutes acceptance.
